Common Questions

Motorcycle questions, answered

Does Florida no-fault (PIP) insurance cover motorcycle accidents?

No. Florida's no-fault PIP system does not apply to motorcycles, and riders are not required to carry PIP. The upside is that an injured rider can pursue the at-fault driver directly without meeting the no-fault injury threshold. The downside is that your own crash-related medical coverage may be limited, which is why health insurance and Uninsured/Underinsured Motorist coverage matter so much.

Do I have to wear a helmet to ride legally in Florida?

Riders 21 and older may legally ride without a helmet if they carry at least $10,000 in medical benefits coverage. Riders under 21 must wear a helmet. Whether or not you were wearing one, you still have the right to pursue compensation from the driver who caused your crash. We focus the case on the other driver's negligence, not on second-guessing the rider.

The driver says the motorcycle was at fault. Can I still recover?

Often, yes. Drivers and insurers are quick to blame the rider regardless of what actually happened. We counter that bias with crash reconstruction, witness statements, and physical evidence showing how the other driver caused the wreck. Florida also follows modified comparative negligence, so even partial fault on your part only reduces your recovery rather than eliminating it, as long as you are not more than 50% at fault.

How long do I have to file a motorcycle accident claim in Florida?

For most motorcycle accident claims, Florida's statute of limitations is generally two years from the date of the crash. Waiting can cost you, because witnesses move, memories fade, and physical evidence at the scene disappears. The sooner you involve a lawyer, the sooner we can preserve evidence and build the strongest possible case before that deadline runs.

What can I recover after a motorcycle crash?

You may be able to recover your medical expenses, lost wages and reduced earning capacity, and pain and suffering. Because motorcycle injuries are often severe and long-lasting, we document the full lifetime cost of your harm, not just today's bills.
